for you second problem I'm not sure but could it be that you made your backup under a different user from which you're trying to restore the files to
If not maybe it is the HD that has the permissions conflict. try fixing the permissions on that HD using Disk utilities if that fails to fix your problem, try to get info on that HD and change the permissions so you're the owner
I could be wrong but this is something to start with.
